GENERAL TERMS OF SALE
Preamble
Site’s Property: the site is the property of Parapharma Stock Company in its totality.
Any integral or partial reproductions are prohibited without the prior authorization of Parapharma Stock Company.
The present general terms of sale apply in an exclusive way between the Parapharma Stock Company and any person visiting or purchasing via the www.parapharmastock.fr site. (Hereafter “You”)
1. Acceptance of the general terms of sale
Beforehand the placement of order, you admit having taken cognizance of the general terms of sale stated on this screen and expressly certify to accept them without reserve. The present general terms of sale govern the contractual relations between You and Parapharma Stock Company. They will prevail on all other conditions appearing in any other document, excepting a written Parapharma Stock Company’s Agreement. This present general terms of sale can be modified at any time by Parapharma Stock Company, without advance warning. The applicable conditions will be those prevailing at the time of the order’s validation.
2. Products
Products offered are those which appear in the catalogue published on this Web site. These products are offered within the limit of stocks available. The photographs and texts illustrating the products are communicated as an indication and aren’t contractual. The offered products by Parapharma Stock Company are complied with the prevailing French legislation and the standards applying in France and in the European Union. Unfortunately, Parapharma Stock Company can’t guarantee the total conformity of the offered products with applied standards in other countries than those inside European Union. Parapharma Stock ensures the sending of the offered products to the customers in more than 230 countries and covers the zones: French Metropolitan, French overseas departments and territories, European Union, and International in their near entirety. The complete list of the countries covered by our shipment services is available on our Web site in the heading “Delivery and Returns”.
3. Order
You declare being major and having legal capacity or being titular of a parental authorization allowing You to place an order on the Site. The automatic-recording systems are regarded as being worth proof of the nature and the contents of the order. To place an order on Parapharma Stock’s site, the customer must first have created an account whose methods and information will be explained at the time of recording. Before confirming your order and accessing the payment’s phase, you must preliminary have accepted without reserve the entirety of the General terms of Sale. The recorded site’s data constitute the proof of the whole transaction passed between You and Parapharma Stock Company. The data recorded by the payment system constitute the proof of financial affairs. When payment is accepted, Parapharma Stock confirms the acceptance of your order in the email address communicated to Parapharma Stock Company. A recap of the order and an invoice will be joined in. At the same time You will receive a second e-mail indicating the availability of the product. If one or several products are unavailable, our department will notify to you a date of restocking. The sale will be concluded at the moment of the payment validation by Parapharma Stock which is the validation’s date of the credit card payment, PayPal or transfer Payment. The confirmation of the payment will be done by the sending of an email at your address.
In any event Parapharma Stock reserves the right to refuse or cancel any order from customer with whom would exist a disagreement relating to the payment of former orders.
4. Price and payment
The price is expressed in Euros all taxes included (French VAT and other applicable taxes). The invoiced VAT is equal to basic rate such as it is applied in Metropolitan France for this type of products, which is 19,6% or 5.5%. VAT rate indicated on your invoice corresponds to the VAT rate of ordered and sent articles. “Our Price” includes the French VAT at the corresponding rate. The price indicated on the product file cards doesn’t include shipping fees. The price indicated during the moment of “confirmation of order” is the definitive price, expressed all taxes included. This price includes the price of products, handling charges, preservation charges, shipping fees and insurances costs. The price is payable cash at the day of the order’s confirmation.
For the customers except Metropolitan France, Parapharma Stock Company has, in accordance with legally required standards, to invoice the VAT in orders sent in most European Union’s countries. Orders delivered apart from European Union are not subjected to VAT, but can be subjected to local taxes and customs taxes into force in the country of reception. It’s also related to orders delivered in French overseas department and territories (TOM/DOM) and other territorial collectivities. For orders in which forwarding addresses are located in European Union, VAT is detailed in the last page of the order, in e-mail acknowledgement of delivery as well as the invoice attached with the order.
Warning: Any inaccurate information provided by the Purchaser in order to evade VAT can involve civil fines and criminal prosecutions.
The payment of products ordered on Parapharma Stock’s Site can be made:
1) By bank card (Credit card, Visa, Mastercard/Eurocard, American Express), directly on line. For this purpose, Parapharma Stock Company chose: “Paiement CIC”. “Paiement CIC” allows you to pay via a banking host which belongs to CIC Bank. The phase of payment in its entirety is realized between you and the CIC. During the phase of credit card payment, you will leave the site temporarily, and will be redirected to “Paiement CIC”.
“Paiement CIC” is the guarantee that:
- Parapharma Stock will never know your card number.
- the CIC Bank will never know the detail of your purchases because only the entire amount of your order and the number of order are transmitted to “Paiement CIC” by the merchant. The order will be automatically cancelled and the customer will be warned by email in the case where concerned banking payment centers would have refused to give their agreement. The implementation of this procedure, which could not be regarded as a guarantee against any fraudulent use of bank card, can’t make Parapharma Stock Company responsible and differs the payment’s validation to the ending procedure of checking. It will be able to lead to the order’s cancellation. In addition, Parapharma Stock Company reserves the right to refuse any credit card payment whose amount would exceed 200 Euros.
2) By PayPal payment within the limit of 500 Euros except costs of postage.
3) By transfer payment for any purchase higher than 1500 Euros except costs of postage. Parapharma Stock Company reserves the right to refuse any payment by transfer payment for orders whose amount is lower than 1500 Euros except costs of postage.
5. Retention of title clause
In accordance with the French Law of May 12, 1980, ordered products remain the property of Parapharma Stock Company until the complete payment by the customer. In case of non-performance of the customer’s obligations, no matter the reasons, Parapharma Stock Company will be able to require immediate restitution of the products. Expenses and risks will be born by the Purchaser.
6. Availability and forwarding
All lead times announced on Parapharma Stock Site is expressed in work days (except Sunday and bank holidays in accordance with the local Law of Alsace-Moselle, registered office of PARAPHARMA STOCK Company).
Each product file card indicates:
• Either the presence in stock of the product concerned: the indication “in stock” corresponds to stock’s state at the time of the order.
• Or an availability date: the availability date corresponds to the theoretical restocking date in our Company. This date depends on the lead time communicated by our suppliers and/or manufacturers of the products and varies according to the type of product.
• Or the word “pre-order”: the products concerned are new products announced by suppliers and/or manufacturers, without an availability date.
• Or the word “out of stock”: the product is temporarily unavailable regarding to our suppliers.
• Or the word “Blue Light Special”: the product benefits from an exceptional price-cutting; the offer is valid temporary on a first-come first-served basis.
• The word “special offer” or “marked down”: Products concerned benefit temporary from a price-cutting on their selling price. The orders are handled, prepared and dispatched, in other words given to our freight operator, within 5 work days from:
• The Reception of the product by Parapharma Stock Company, regarding to product availability.
• Validation of the payment by the customer and the bank’s acceptance, when orders are made by bank card in line, PayPal or transfer payment, regarding to products in stock at the time of their validation or reception.
• Reception of the products by Parapharma Stock Company, when those become indeed available to our supplier, regarding to products in pre-order.
• Orders are usually handled after validation of the credit card payment. The indication «in stock» and the availability period could vary between the date of the order and, depending on the case, the date of payment validation by bank card.
Date of Products availability could be modify due to suppliers and/or manufacturers. In such cases, dates of availability will be those established at the time of the credit card payment validation.
However, provided dates are only theoretical ones and can undergo some changes, which will be communicated to customers by e-mail.
• In case of unavailability of the products:
- definitive unavailability: If available products at the time of the order become, thereafter, for some reasons, definitively unavailable, Parapharma Stock Company has to inform customer and shall either offer articles of substitution, or reimburse missing articles to him, without delay or at the latest in the 30th day in accordance with the provisions of L121-20-3 article of Consumption Law.
- temporary unavailability: If available products at the time of the order become, thereafter, for some reasons definitively unavailable, Parapharma Stock Company has to inform customers when the product will be restocked.
Then the customer has the choice of either maintaining his order with these new deadlines, or cancelling it.
In that case, Parapharma Stock Company shall reimburse missing articles without delay and at the latest in the 30th day in accordance with the provisions of L121-20-3 article of Consumption Law.
When the customer takes order of one or more articles of which the availability is not immediate, the order will be sent when whole of the products will be available. From the product’s availability, the order will be handled within 5 days as envisaged higher.
7. Shipment
Products bought on www.parapharmastock.fr Site are shipped through 230 countries.
Regard to forwarding, we work with La Poste’s Colissimo Service. Colissimo is a fast delivering service.
- For the “France Metropolitaine” Zone: the delivery will be made by Colissimo Access F or Colissimo Expert F within 48h for any package lower than 30 kilos.
- COLISSIMO ACCESS F Packages are delivered to addressee only (indicated by the shipper) without signature.
- COLLISSIMO EXPERT F Packages are delivered to addressee only (indicated by the shipper) and require his signature upon delivery or the signature of any person attached to his office or abiding with him or specially mandated or by any other agreed availability with La Poste. This service has been included in the costs of postage and is invoiced 2 Euros no matter the amount.
- For the “Overseas” Zone : The delivery will be made by Colissimo Expert OM Service within a lead time between 5 and 7 days from its delivering to the postal service for any package lower than 30 kilos towards the DOM, Mayotte Saint-Pierre and Miquelon and for any package lower than 10 kilos towards TOM and “Postal Districts”.
Packages will be delivered to addressee only (indicated by the shipper) and require his signature upon delivery or the signature of any person attached to his office or abiding with him or especially mandated or by any other agreed availibilty with La Poste.
- For “European Union and International” Zones: The delivery will be made by Colissimo Expert I Service within a lead time between 3 and 11 days from its delivering to the postal service for any package lower than 30 kilos towards destinations which accept it. The order will be delivered to addressee only (indicated by the shipper) and require his signature or the signatures of any person attached to his office or abiding with him or specially mandated or by any other agreed availability with “La Poste” Service.
Colissimo Expert I Covered zones
Zone 1: Germany, Belgium, Netherlands, Luxembourg
Zone 2: Great Britain, Italy, Spain
Zone 3: Austria, Denmark, Ireland and Portugal
Zone 4: Finland, Norway, Sweden and Switzerland, the Azores, Madeira, the Canaries

Zone 6: Other Countries of Eastern Europe and the Maghreb
Zone 7: The USA, Canada, Africa and the Middle East
Zone 8: America except the USA and Canada, Asia and Oceania
When packages could not be delivered because of letter-box sizes insufficiency and/or absence of recipients or competent persons, a delivery notice is given by “La Poste Service” in the recipient’s letter-box of. The delivery notice indicates the coordinates of the post office where the recipient will be able to freight collect the consignment.
Forwarding Charges
If your order exceed 89 Euros (including all taxes), the shipment is free. This offer is valid only for Metropolitan France. For orders whose amount don’t exceed 89 Euros and for all orders placed in Overseas, European Union, and International Zones covered by our site, a shipment and handling charges contribution will be invoiced.
For the “Overseas” Zone, European Union and International Zones covered by the Website, a contribution to insurance cost included in forwarding charges will be invoiced.
You can consult the shipment charges grid applied in covered zones by Parapharma Stock’s Site in the “Delivery and returns” Section. Parapharma Stock Company, in any event, will be released from its obligation to deliver in the event of:
• case of force majeure incidence such as wars, riots, fire, strikes, accidents and the impossibility to be supplied.
• Non-performance by the customer of any of its obligations (price payment, rightness of information communicated such as forwarding address…)
8. Package follow-up
You will be informed, in real-time, via an email sent to your address the forwarding of your package. Package handling is done via “Colissimo Suivi” Service from the Post office; it will enable you to check up the delivering status of your package thanks to the number which will be given to you during the forwarding of your order. You will be able to follow your package by connecting you to: http://www.coliposte.fr then by entering, in “Espace Particulier”, your package’s number (13 characters.) However, for all orders except Metropolitan France, the follow-up of the packages depends on the country of destination.
For orders placed In overseas (Outre-Mer):
- The package follow-up will be “complet” from deposit to delivery for the following destinations: DOM and Mayotte.
- the package follow-up will be “partiel”, i.e. until the edge of the Metropolitan France for forwarding towards TOM, Saint-Pierre et Miquelon and the Postal districts.
For orders placed in International Zone: The follow-up depends on countries of destination; it can be - either from deposit to delivery or until the edge of Metropolitan France. You can consult the type of package follow-up on our site in the “Delivery and returns” section. Depending on La Poste’s Service, Parapharma Stock Company is not responsible for delivering delay. Any necessary mention which is erroneous or missing, in forwarding address and customer’s identity exonerates Parapharma Stock Company from delivering responsibility. In that case of package return of for incomplete address (ex: Residence, building, company, etc… is missed), the charges related to package forwarding will be the responsibility of the customer. Parapharma Stock Company commits to do the necessary to deliver orders within the next 30 days of the bank card payment validation. Moreover, the customer commits to settle all taxes included, tax on the added-value, and all other taxes due to laws applied in all covered zones. All placed orders in our website are exclusively for private use; customers or product beneficiaries are forbidden from reselling products. Parapharma Stock Company could not be responsible for taxes non-payment of which the customer is bound.
9. Package receipt
Whatever the place of delivery, this one is made to the address indicated during order placing by the customer. It will be made via Colissimo ACCESS F or Colissimo EXPERT F Service.
- COLISSIMO ACCESS F Packages are delivered to addressee only (indicated by the shipper) without signature.- with - letters with the address indicated by L `shipper without signature.
In the case of letterbox with insufficient dimensions, packages are delivered at home. The packages will be given either to the recipient, or to a person attached to his service, or abiding with him or specially mandated. It could also be given, due to La Poste’s Service, to a person who has got power of attorney or an identified third party.
- COLISSIMO EXPERT F Packages are delivered to addressee only (indicated by the shipper) and require his signature upon delivery or the signature of any person attached to his service or abiding with him or specially mandated or by any other agreed availability with La Poste’s Service.
- COLISSIMO EXPERT OM packages are delivered to addressee only (indicated by the shipper) and require his signature upon delivery or the signature of any person attached to his service or abiding with him or specially mandated or by any other agreed availability with La Poste’s Service.
- COLISSIMO EXPERT I packages are delivered to addressee only (indicated by the shipper) and require his signature upon delivery or the signature of any person attached to his service or abiding with him or specially mandated or by any other agreed availability with La Poste’s Service.
When packages could not be delivered because of letter-box sizes insufficiency and/or absence of recipients or competent persons, several presentations of the package can be made by the Post office to addressee the very following day or a delivery notice is given to the recipient. The delivery notice indicates the coordinates of the post office where the recipient will be able to freight collect the consignment.
In that case any object is given to its recipient or his representative, duly capacitated, on presentation of identity papers and his signature if it is required.
The duration of this procedure is 15 consecutive days from the very following day after the registration of it.
A great care is given to packing and package making, however some of them can be damaged during transport.
In the case where Packages are delivered to addressee only (indicated by the shipper) and require his signature upon delivery : Regarding to you, if the cardboard box looks damaged or half-opened we don’t recommend you to accept the package, this one will be returned to us and we suggest you to notice precisely, during the delivering of your package, in addition to your signature, reservations on the delivery order, and to reiterate them through the freight operator with registered letter with acknowledgement of receipt within the next three days of the delivery in accordance with L.133-3 article of the French Commercial Law.
In the case here packages are delivered to addressee only (indicated by the shipper) without signature: The same procedure is applied except that the customer must refuse the package and must produce an attestation from the freight operator or competent postal services which proves that the package has been damaged.
Moreover, in both cases, you have to inform Parapharma Stock Company by email at contact[at]parapharmastock.fr and with registered letter with acknowledgement of receipt and by email for all damages due to transport within the next eight (8) days following the receipt. No complaint will be accepted in the event of non-observance of these formalities.
Without reservations, we will not answer to your complaints.
In the same way, during the order reception, we recommend you to check the conformity of the delivered products, any reserve on the conformity of the delivered goods must be mentioned on the delivery order and reiterate through us by registered letter with acknowledgement of receipt within the next three (3) days following the order receipt.
Without any mentions on the order delivery, email and complaint done with registered letter through our services no complaint will be allowed in the event of non-observance of these formalities. If it proves that one or several products are not in accordance with their orders, customers will have to support return charges for non-compliant products. We will return it to our charges, as soon as we receive the returned products in accordance with the customer order.
10. Warranty
In any case, customers profits from the legal warranty of latent defects (Art.1626 and following of Civil code). On the condition that the purchaser has the proof of the latent defects , the salesman has to repair all the consequences (art.1641 and following of the Civil Code).
Parapharma Stock Company don’t guarantee
1. Deteriorations due to usury or foreign causes to intrinsic qualities of goods.
2. Non compliant Uses and maintenance with the product’s user guide given as well as defaults of use or maintenance.
3. Deteriorations due to handling errors, or abnormal connections (No matter the accessories used by the customer), to abusive or wrong uses (overload, moisture or excessive heating, etc…), to intentional or accidental physical modifications, for commercial or professional purposes.
4. Spare parts or accessories whose substitution results from their normal wear and tear, or normal maintenance operations: (ex: light bulbs, batteries, joints, etc…)
5. Costs of postage and equipment modification, in the event of a callback for manufacturing fault.
6. Deteriorations due to external events (lightning, water damage, etc…).
7. Interventions done on equipment by any person who’s not mandated by the After-sales service as well as dysfunctions and deteriorations due to such intervention.
11. Limitation of responsibility
The offered products are in accordance with the French legislation into force. Parapharma Stock Company declines any responsibility on the supposition that delivered articles would not respect the legislation of a country other than France. It belongs to you to check to local authorities importation possibilities or products’ uses or services you plan to order.
Parapharma Stock Company declines any responsibility whatever product uses which would exceed or would differ from its normal use.
Parapharma Stock Company declines any responsibility in the event of allergic reactions arisen during the use of one of the products sold on the website. Before any order and all the more before any use, the customer makes the commitment to take the necessary precautions in order to make sure that there is no possibility of allergic reactions or incompatibilities between his state and one of the elements composing the aforementioned products.
The information given on the site, photographs, product descriptions, prices… are given as a rough estimate only. Parapharma Stock Company endeavours to information accuracy presented on the site. Possible mistakes, especially in English product description translation, are merely fortuitous and will be corrected as soon as possible.
Parapharma Stock Company could not be held responsible for simple errors or omissions which could have subsisted despite all the precautions taken in the products presentation as well as possible modifications of the products decided by the manufacturers. The photographs are communicated as a rough estimate only. We invite you to consult descriptions of each product in order to have a thorough knowledge of their precise characteristics; if in doubt or if you wish further information, do not hesitate to contact us. In case of obvious mistakes between products characteristics and its presentation and/or the terms of sale, Parapharma Stock Company’s responsibility could not be committed. Due to the number of products available and their source, it may be that several notes cannot be available in English or in your language. We advise you in that case to take cognizance of their characteristics through their manufacturers or simply by asking your questions via our contact form. In accordance with the Law in force, Parapharma Stock Company is not responsible for non-performance or bad performance of the contract which would be imputable either to the consumer, or to insurmountable and unpredictable fact or to a third party or to a case of force majeure. No matter the case We can’t be held responsible for losses of benefit, commercial losses, data losses or shortfall or any other indirect damage which are not predictable at the time of the use of the Site or the conclusion of the sale contract between Us and You. The limitation of responsibility above is inapplicable in the event of fraud or gross negligence of our part, in the event of physical injuries or liability for defective products, in the event of eviction and non-compliance (including latent defects). In the case of hypertexts linking other sites starting from the www.parapharmastock.fr site, we will not be held responsible for the contents of the information given on these sites after activation of these links.
12. Retractation
In accordance with L.121-20 articles and following of the French Consumption Code, the customer has a 7 days deadline from the delivery date to return the product in his original packing for substitution or reimbursement. The return will be only accepted if the product was not opened or used. Sold blister packages or products with warranty label must be returned in state. Reimbursement will be done within the next 30 days following the date on which the customer exercised his right to retraction (L121-20-1 article of the French Consumption Code).
13. Anti-Frauds Controls
Within the framework of the orders’ control, our customers service department can also made any controls in order to validate your order. Indeed, these controls aim at protecting Parapharma Stock from abusing practices operated by defrauders. At the time of the audit process, the customers service department could ask you all necessary information in order to place your order: a proof of domicile and/or coordinates of credit card owner, identity paper etc... 14. Data protection
Personal data relative to customers are essential for the treatment and orders delivery, invoices preparation and contracts of guarantee.
The lack of information involves the refusal of the order’s validation.
In accordance with the " Informatique et Libertés " Law, the personal data processing relative to customers was declared to the French National Commission for data protection and the liberties (CNIL), number of declaration 1293678.
According to the 34th article of the French Law of January 6, 1978 you have the right to access, modify, correct and suppress all data related to you. These rights can be exercised through Parapharma Stock Company. Moreover, Parapharma Stock Company commit itself not to communicate, free or with counterpart, customers personal data to a third party. In accordance with the French Law nº 98-536 of July 1, 1998 about legal protection of databases, Parapharma Stock is producer and owner of whole or part of its website’s databases. While entering the present website, You admit that the data composing it are legally protected, and, in accordance with Law mentioned before-said, you abstain from extracting, re-using, storing, reproducing, representing or keeping, directly or indirectly, by any means whatsoever and whatever the medium, whole or part qualitatively or quantitatively substantial, of databases contents appearing in this site.
15. Court’s Jurisdiction and applicable Law
The present General terms of sale is governed and interpreted by the French Law. In the event of possible disputes and after an attempt for an out of court settlement, the courts of Mulhouse (France) will be the court of competent jurisdiction. In case of any dispute related to the present General Terms of Sale, even in the event of plurality of defendants or claim for contribution from third party and no matter the payment terms.
Court of competent jurisdiction is expressly given in favor of PARAPHARMA STOCK Company which can refer to any court it wants.
